Fisherman wins £45k compensation

A lobster fisherman from Castletown, Caithness who suffered severe whiplash injuries following a collision with another car, successfully sued the insurers of the driver of the other vehicle in 2008. The settlement figure received by Donald Bremner, then 42 was £45,000. The driver of the other vehicle, Mr Bartlett did not contest liability although there was some debate as to a fair compensation amount.
Bremner was unable to return to work due to the whiplash injury and also claimed for fishing gear that was lost at sea following the accident. Mr Bartlett’s lawyers claimed that the loss of fishing gear at sea could in no way be directly attributed to the accident and therefore should not be included in the compensation amount awarded.
The £45,000 that was awarded to Bremner at the Courts of Session in Edinburgh included compensation for loss of wages up to 2006 as well compensation for pain and suffering as a result of the painful whiplash injury. The accident happened on the A9 Scrabster to Thurso road in Caithness when Bartlett’s car collided with the rear end of Bremner’s.
